Losing a loved one is difficult enough without the added stress of making important financial and legal decisions while grieving. At the Estate Planning and Legacy Law Center, we will use our years of experience and understanding of what you are going through to make the estate and trust administration process as efficient and stress-free as possible. We will guide your heirs compassionately and work closely with executors, personal representatives, trustees and other fiduciaries to ensure your wishes are carried out.
Probate
Simply put, Probate is the court-supervised administration of a decedent's estate. Unfortunately, in the state of Florida probate can be extremely complicated, unnecessarily expensive, time-consuming, highly public and often frustrating process. Worse, it is made even more difficult by the grief that accompanies losing a love one. While we devote much of our practice to helping our clients avoid probate, we can lead your family through the legal labyrinth with compassion and understanding.
Trust Administration
Many of our clients wonder what is involved in administering a trust, and whether they should accept the role of trustee. There are a wide range of duties and responsibilities involved in administering a trust: statutory notice requirements, the prompt payment of expenses, distributing assets to heirs in the manner dictated by the trust, and many more. In addition, there are personal liability risks for the trustee. Needless to say, the decision to serve as trustee is an important one and should only be taken with a thorough understanding of the duties and risks involved. We can help you understand the risks and guide you through the process if you decide to act as trustee. We can also help you select an appropriate trustee if you do not wish to take on the responsibility yourself.
